These Terms and Conditions ("Terms") govern your use of the Activisure platform, including our mobile application and website (collectively, the "Service"), operated by Activisure Ltd ("we", "us", "our"). By registering for or using the Service, you agree to be bound by these Terms. Please read them carefully.

1. About Activisure

Activisure is a UK-based platform that connects sports coaches ("Coaches") with clients ("Clients"). We provide tools for session booking, payment processing, progress tracking, and communication. Activisure is a marketplace and does not itself provide coaching services.

2. Eligibility

You must be at least 16 years old to create an account. By registering, you confirm that:

• You are at least 16 years of age (or 18 if entering into payment arrangements).
• You have the legal capacity to enter into a binding agreement.
• All information you provide is accurate and complete.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@activisure.com if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Coach Responsibilities

Coaches who use Activisure agree to:

• Provide accurate information about their qualifications, experience, and services.
• Hold any required certifications, licences, or insurance required to offer their coaching services in the UK.
• Deliver sessions professionally and as described to clients.
• Connect a valid UK bank account via Stripe to receive payments.
• Comply with all applicable UK laws and regulations, including safeguarding requirements where relevant.

Activisure does not verify coach qualifications and is not responsible for the quality or safety of coaching services provided.

5. Client Responsibilities

Clients agree to:

• Pay for booked sessions in full at the time of booking.
• Attend sessions at the agreed time or provide reasonable notice of cancellation.
• Treat coaches with respect in all communications on the platform.

6. Payments and Fees

All payments are processed securely through Stripe. By using our payment features, you also agree to Stripe's Terms of Service.

• Session payments: Clients pay the full session rate at the time of booking.
• Platform fee: Activisure charges a 5% service fee on each session, applied to both the coach payout and the client charge.
• Coach payouts: Coaches receive 95% of the agreed session rate, transferred to their connected Stripe Express account upon session completion.
• Refunds: Refund decisions are made at Activisure's discretion. Where a session is cancelled or marked "Not Completed" without fault of the client, we will endeavour to process a refund promptly.

7. Cancellations and No-Shows

Cancellation policies are set by individual coaches and displayed on their profiles. Activisure is not responsible for enforcing individual coach cancellation policies, but we may intervene where a pattern of disputes is identified.

8. Prohibited Conduct

You must not use Activisure to:

• Post false, misleading, or fraudulent information.
• Harass, abuse, or threaten other users.
• Circumvent the platform to arrange off-platform payments for sessions booked through Activisure.
• Upload or share content that is unlawful, harmful, or infringes third-party rights.
• Attempt to access systems or data you are not authorised to access.
• Use the platform for any purpose that violates applicable UK law.

Violation of these rules may result in immediate account suspension or termination.

9. Intellectual Property

All content, branding, software, and technology on the Activisure platform is the property of Activisure Ltd or its licensors. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

By submitting content to the platform (such as profile information, photos, or messages), you grant Activisure a non-exclusive, royalty-free licence to use that content solely for the purpose of operating and improving the Service.

10. Limitation of Liability

To the fullest extent permitted by UK law, Activisure Ltd shall not be liable for:

• Any indirect, incidental, or consequential loss arising from your use of the Service.
• The acts or omissions of coaches or clients on the platform.
• Any loss of data, revenue, or business opportunity.

Our total liability to you for any claim arising out of these Terms shall not exceed the total fees you have paid to us in the 12 months preceding the claim.

11. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, or free from viruses. We are not responsible for third-party services integrated with the platform (such as Stripe or Google).

12. Termination

You may delete your account at any time from within the app. We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Your continued use of the platform after the effective date of any changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
